Microsoft has formally filed against DHL for $2 million worth of damages as a result of damaged Xbox 360s on a DHL train that derailed in Duke, Texas. The wording in the complaint indicates that the Xbox 360s suffered from “impact damage, wetting, pilfering and shortage.” If this situation is any indication of emotion, executives at Microsoft Game Studios must be reallysteamed.
The reason for the filling had to deal with the way DHL “negligently breached its duties as a common carrier, handler, bailee, warehouseman, agent or in other capabilities.” In other words, they were a bitoff the railsin terms of owning up to the loss of cargo.
One wonders if the engineer of the train was busy drinking because he was analcoholicwhobeats his wife. This is fairly unfortunate for all those involved. Especially for all the people who were set to get these units after the shipment was received in Hong Kong. In the future, Microsoft should probably stick to shipping things by plane. I hear that it’s rare when air cargo gets lostout of the blue.
